Abstract
Bir tıbbi müdahalenin ilk şartı olan ve hasta ile tabip arasındaki sözleşmenin kurulmasını sağlayan irade beyanı, etki faktörü yönünden Türkçeden yaklaşık yirmi kat daha etkin olan İngilizce dilinde, "Informed Consent" olarak adlandırılmıştır. Bu terim Türkiye sağlık ve hukuk sisteminde farklı ifadelerle karşılık buluyor olsa da "Aydınlatılmış Onam" en sık kullanılan tamlamadır.
Terimler, kavramları adlandıran kelimelerdir. Yabancı terimlere Türkçe karşılık aranırken, sadece kavrama ad olan kelimenin sözlük anlamı değil, kavramın kendisinin de dikkate alınması gerekmektedir. Türkçeleştirme çalışmalarında yabancı dil kökenli kelimelere birden fazla kurum veya kişi tarafından farklı karşılıklar bulunması ya da bir terimin aynı kurum tarafından birden fazla kelime ile karşılanması ise o bilim dalında kavram karmaşasına yol açacaktır.
Makalemizde, her açıdan önemli bir işlevi haiz "Informed Consent" teriminin, farklı şekillerde Türkçeleştirilerek kullanılması konusu, kullanılan kelimelerin Türkiye hukuk sisteminde nasıl yer bulduğunun saptanması yolu ile irdelenecektir. The declaration of intention, which is the primary condition of medical intervention that enables a contract to be established between the patient and physician, is described as "Informed Consent" in the English language, which is about twenty times more effective than Turkish in terms of impact factor. Even though the same phrasal meaning can be conveyed using various terms in Turkish health and legal systems, “Aydinlatilmis Onam" is the most oft-used conception.
Simply put, a term is a word that expresses a concept. In order to propose a corresponding term in Turkish, not only the lexical definition of the phrase that describes a concept but also the meaning of the concept itself should be taken into account. In the process of establishing equivalent terms in Turkish, when personal or juridical legal entities assign different native words to the same foreign term, or if an intra-organizational discrepancy exists, an issue of comprehensibility within the scientific field would most certainly arise.
In this study, we will discuss various Turkish descriptions for the term “Informed Consent”, which boasts such broad and vital functions, by determining connotations the assigned words have within Turkish legislation.
