Cinsel şiddet mağduru çocuk kavramı ve Türk Ceza Kanunu'nun çocuğa yönelik cinsel şiddet düzenlemelerine genel bakış

Abstract

Çocuğa karşı cinsel istismar, şiddetin bir türüdür ve maalesef oldukça yaygın olmakla birlikte ortaya çıkmayan ve bu nedenle adliyeye yansımayan dolayısıyla da istatistiklere geçmeyen bir büyük bir sorundur. Ulusal olduğu kadar uluslararası boyutu olan bir konudur. Çocuğun genellikle yakınından gördüğü ve bu nedenle de faillini tanıdığı fiile karşı yasal düzenlemeler yapılmakta ancak bununla yetinilmemektedir. Uluslararası sözleşmelerle konu gündemde tutulmakta ve önlenmesi için taraf devletlere yükümlülükler yüklenmektedir. Türk Ceza Kanunu'nda da konuya ilişkin düzenlemeler bulunmakla birlikte sorunu çözmek bakımından yeterli olduklarını ifade etmek mümkün değildir.

Child sexual abuse is a type of violation and despite the fact that it is a common issue, it doesnt come into the picture much and therefore, it is not referred to court and reflected by the statistics. It is also an international problem as well as a national issue. Children usually see the offender and know he/she who commits the action and regulations made for this crime is not adequate yet. International conventions keep this issue on the agenda and some obligations are imposed to States to prevent it. Even tough there are provisions on this topic in Turkish Criminal Code, these are not efficacious for solving the problem.
