Çocuğun soybağının kurulması ve yardımcı üreme teknikleri sonucu soybağının tespiti

Abstract

4721 sayılı Türk Medeni Kanunu na göre soybağı, kan bağına dayanarak doğal yollarla kurulabileceği gibi, evlat edinme ile meydana gelen yapay yol ile de kurulabilir. Çocuğun anne ve babasıyla soybağının kurulması farklı hü- kümlere tabidir. Ancak hukukumuzda, günümüzde çok sık karşılaşılmakta olan yardımcı üreme teknikleri ile ilgili bir düzenleme bulunmamaktadır. Bu üreme teknikleriyle dünyaya gelen çocuğun soybağının tespiti de kullanılan üreme tekniklerine göre farklılık arz eder. Bu makale, soybağının kanundaki düzenlemelere göre kurulması ve yardımcı üreme teknikleri sonucu doğan çocuğun soybağının tespit edilmesi ile ilgilidir.

According to Turkish Civil Code No: 4721, filiation can be established both in a natural way, based on blood tie and in an artificial way occurred by adoption. The establishment of filiation of child s mother and father are subjected to different provisions. However, there are no regulations related to assisted reproductive techniques which are very common today in our legal system. The determination of the child s filiation, born with this assisted new reproductive techniques vary according to the reproduction technology used. This article is about the establishment of the filiation according to regulations in law and determines the filiation of the child born as a result of assisted reproductive techniques.
