Kadına karşı şiddet-cinsel şiddet kavramı ve Türk Ceza Kanunu m. 102'ye genel bakış

Abstract

Türkiye'nin önemli ve ciddi sorunlarından olan şiddet ve özellikle kadına karşı şiddet her geçen gün artarak devam etmektedir. Konu artık basit bir suç algısından çıkartılarak insanlık suçu boyutunda ele alınması gereken ciddiyet kazanmış durumdadır. Şiddetin bir türü olarak ortaya çıkan cinsel şiddet ise oldukça yaygın boyutlardadır. Çoğunlukla farklı nedenlerle ortaya çıkmayan, çıkartılmayan ve bu nedenle de adliyeye de yansımayan ve istatistiklere geçmeyen büyük bir sorundur üstelik. Sadece ülkemiz için değil tüm dünya için büyük bir problemdir. Türk Ceza Kanunu'nda da kadına yönelik cinsel şiddete ilişkin düzenleme bulunmakla birlikte sorunu çözmek bakımından yeterli olduğunu ifade etmek mümkün gözükmemektedir.Violence, especially violence against women, that is important and serious problem of Turkey, increases day by day. The issue should not be approached as a simple perception of crime; indeed, it should be argued as a crime against humanity.Sexual violence which emerges as a type of violence is relatively common. Due to different reasons, most of the time, the big problem does not reveal, cannot be revealed, therefore the problem does not reflect on judiciary and also on the statistics. It is not only the problem of Turkey, but also the problem of whole World. Despite the regulation in Turkish Criminal Code, it is not possible to say that's enough to solve the problem.
