Tıbbi müdahalede aydınlatılmış rıza

Abstract

Hukuka uygun bir tıbbi müdahalenin ön şartı olduğu hususunda öğreti, uygulama ve mevzuatta genel kabul gören “Tıbbi Müdahalede Aydınlatılmış Rıza" konusunda hazırlanan bu çalışmada, öncelikle tıbbi müdahaleye rızanın konusunu teşkil eden tıbbi müdahaleler özellik arz eden türleri ile birlikte incelenmiştir. Tıbbi müdahale konusu tüm yönleriyle ele alındıktan sonra bu müdahalenin ön şartı olan aydınlatma konusu ele alınmış, aydınlatmanın amacı, kapsamı, yükümlüsü, muhatabı, şekli ve zamanı detaylı bir şekilde ele alınmıştır. Son kısımda ise aydınlatmaya dayalı olarak alınması gereken “tıbbi müdahaleye rıza” ile ilgili detaylı bir inceleme yapılarak, tıbbi müdahaleye rızanın hukuki niteliği ele alınmıştır. Rızayı doğrudan düzenleyen uluslararası ve ulusal mevzuat ele alınarak incelenmiş, ardından rıza konusunda çok önemli bir konu olan ehliyet konusu medeni hukuk kavramlarına ve ceza hukuku kavramlarına da başvurulmak suretiyle detaylı bir şekilde ele alınmıştır. Son olarak rızanın kapsamı, zamanı, şekli, rızayı sakatlayan haller, rızayı geri alma, esirgeme, tedaviyi reddetme hakkı ve rıza aranmayan haller ele alınarak çalışmaya son verilmiştir. Böylece bir mantıki silsile ve biri diğerinin önceli ve şartı olmak üzere, incelememiz tıbbi müdahale, aydınlatma ve tıbbi müdahaleye rıza başlıkları altında incelenerek tamamlanmıştır.

In this study, which is prepared on the subject of "Information and Informed Consent in Medical Intervention", which is generally accepted in the doctrine, practice and legislation that a legal medical intervention is a prerequisite, first of all, medical interventions are required. Subjects of consent were examined together with their specific types. After all aspects of the medical intervention, the subject of illumination, which is the prerequisite of this intervention, was discussed, and the purpose, scope, responsible, addressee, form and time of the enlightement were discussed in detail. In the last part, a detailed examination of the "consent", which should be obtained based on enlightenment, was made, and first of all, the terminology was discussed in the context of the terms consent and then its legal nature was discussed. The international and national legislation that directly regulates consent has been examined, and then the issue of competence, which is a very important issue in consent, has been discussed in detail by referring to the concepts of civil law . Finally, the scope, time and form of consent, the conditions that invalidate consent, the right to withdraw consent, the right to refuse treatment, and the cases for which consent is not sought, the study was terminated. Thus, our study was completed by examining it under the headings of medical intervention, consent, as a logical sequence and one being the precedent and condition of the other.
