ArticlePublication Open Access Cape town convention on international interests in mobile equipment and its additional protocols(İstanbul Üniversitesi, 2020-12-10) Ekşi, Nuray; Law; EKŞİ, NurayIn this study, first, secured transactions and the works carried out by UNIDROIT regarding these transactions will be examined. Later, the Convention on International Interests in Mobile Equipment drafted by UNIDROIT, hereinafter referred to as "the Cape Town Convention", will be explained. Four protocols have been made regarding the Cape Town Convention. These protocols are the Aircraft Protocol, the Rail Protocol, the Space Protocol, and the MAC Protocol. In 2011, Turkey ratified the Cape Town Convention together with the Aircraft Protocol. Some arrangements were made to harmonize our domestic law with the Convention and the Protocol following the ratification of both instruments. These arrangements are also addressed in this study. Our general evaluation regarding the Cape Town Convention and the Protocols to this Convention is presented in the conclusion.ReviewPublication Open Access Estetik amaçlı tıbbi müdahalelerde hekimin hukuki sorumlulukları ve eser sözleşmesi(Medknow, 2016-11-30) Arıncı, A.; Usta, Sevgi; Law; USTA, SevgiGüzelliğin en belirgin tanımı, 18. yüzyıl Fransız Edebiyatçısı Stendhal tarafından "mutluluk vaadi" olarak yapılmıştır. Bu anlayış çağlar boyu değişmemiş ve modern insan daha da etkin biçimde, ‘fiziksel olarak güzel ve kusursuz’ olmayı güç ve mutluluğun kaynağı olarak görülmüştür. Dünya Sağlık Örgütü'nün tanımına göre sağlık; sadece hastalık ve hastalığın olmaması değil fiziksel, ruhsal ve toplumsal (sosyal) yönden de tam bir iyilik halidir. Sağlığın sözlük tanımı; bireyin fiziksel, duygusal, zihinsel ve toplumsal açıdan çevreyle uyum içinde işlev görebilme yeteneğidir. Tanımda sağlığın fiziksel olmasının yanı sıra ruhsal ve toplumsal boyutu da dikkate alınmıştır. Dolayısıyla estetik amaçlı tıbbi müdahale her ne kadar tedavi amacı taşımasa da bireyin temel insan haklarından biri olan kişinin ruhsal iyiliğini de kapsayan sağlık hakkının gerçekleştirilme araçlarından birisidir. Tıbbi müdahale türleri müdahalenin özelliğine göre ayrılmıştır. Tıbbi müdahaleler genel olarak teşhis ve tedavi amacıyla yapılan müdahaleler olarak ortaya çıkmışken tıp bilimindeki gelişim ve değişimler yeni müdahale türlerini ortaya çıkarmıştır. Tarihsel olarak estetik amaçlı tıbbi müdahale; plastik ve rekonstrüktif cerrahi müdahalelerin bir alt dalı olarak ortaya çıkmış ve gelişmiştir. Bu çeşit tıbbi müdahaleler eski çağlardan beri uygulanmakta olmasına karşın, özellikle birinci ve ikinci dünya savaşlarında yaralananların vücut bozukluklarını düzeltmek, doku ve organ kayıplarını onarmak için yapılan ameliyatlar sayesinde büyük bir gelişim göstermiştir. Bu şekilde başlayan çalışmalar estetik cerrah sayısının artmasına ve teknolojideki gelişmelere bağlı olarak da ameliyatların çok daha ucuza yapılabilmesi nedeniyle estetik ameliyatların yaygınlaşmasına sebep olmuştur.ArticlePublication Metadata only Evaluating sanctions in the context of international law(Taylor & Francis, 2021-01-02) Albal, Eymir; Law; ALBAL, EymirN/AArticlePublication Metadata only Prevalence of depression, anxiety, stress, and anger in Turkish prisoners(Wiley, 2013-09) Ünver, Yener; Yuce, M.; Bayram, M.; Bilgel, N.; Law; ÜNVER, YenerIn Turkey, prison studies are rare and the mental health status of prisoners has not received proper attention. The purpose of this cross-sectional and descriptive study was to assess the prevalence of depression, anxiety, stress, and anger among a group of Turkish prisoners. Two self-reporting instruments (the Depression Anxiety Stress Scale-42 and Multidimensional Anger Scale) were filled out by 685 prisoners. Prisoners in the study group were found to be depressive, anxious, and stressed. Anger symptoms and aggressive behaviors were found to be at a moderate level. Prisoners with a history of being subjected to domestic violence in childhood had higher depression, anxiety, and stress scores than those without such a history. Young prisoners, those who had been previously imprisoned, with substance dependency and higher stress and anxiety levels reported more anger symptoms than others. Psychological support, together with stress and anger management programs, seems to be essential.ArticlePublication Open Access Public policy in the enforcement of forein arbitral awards in the light of the judgments of the court of cassation(Istanbul University, 2020) Ekşi, Nuray; Law; EKŞİ, NurayIn this study, first, the concepts of "recognition" and "enforcement" of foreign arbitral awards will be explained. Then, the legal basis for the recognition and enforcement of foreign arbitral awards will be clarified. The principles proposed in the academic circles to prevent the use of public policy beyond its purpose in enforcement of foreign arbitral awards proceedings will be briefly explained. Following that, what is considered by the doctrine to be part of public policy will be addressed. Thereafter, the attempts made by the courts framing public policy as an impediment to the enforcement of foreign arbitral awards will be addressed. In addition, the elements which, in Court of Cassation decisions, are considered to be public policy grounds that justify denial of enforcement of foreign arbitral awards will be evaluated under ten headings. In the last part of the study, the effect of public policy on the enforcement of foreign arbitral awards containing peculiar features will be examined. Three topics will be discussed under this title: first, the effect of public policy on enforcement of interim measures granted by arbitrators; second, the effect of public policy on the enforcement of the RICO or punitive damages awards, and third, the effect of public policy on the recognition of the anti-suit injunctions ordered by arbitrators. Our general evaluation regarding public policy as a bar to enforcement of foreign arbitral awards in terms of Turkish doctrine and practice will be presented in the conclusion.ArticlePublication Open Access Scope of application and railway operators' liability pursuant to bylaw regarding rail passengers' rights(Istanbul Univ, 2021) Meriç, Gülfer; Law; MERİÇ, GülferThe Bylaw Regarding Rail Passengers’ Rights, published in the Official Gazette on March 8, 2019, gives the impression that only the rights of rail passengers are regulated. However, it in fact quite comprehensively regulates the obligations of both rail passengers and railway train operators in addition to the operators’ liability and rail passengers’ rights. This study contains discussions first of the scope of application of the Bylaw and its relation with the other legislation in force, especially the Rumeli Railways Operating Regulation, which is in force since the period of the Ottoman Empire, and the provisions of the Turkish Commercial Code regarding transportation law is discussed. In this context, the need to adopt a law that explicitly repeals Rumeli Railways Operating Regulation is emphasized. The obligations of the railway train operator and the liability arising from these obligations are also examined. Within the scope of a railway train operator’s responsibility, the conditions regarding the operator’s liability are addressed including liability arising from passenger death and injury, release from liability and principles of limitation of liability, and liability for damage or loss of baggage or goods. All these principles stipulated by the Bylaw are compared with national and international regulations on carriage of passengers and goods.
