ReviewPublication Open Access Estetik amaçlı tıbbi müdahalelerde hekimin hukuki sorumlulukları ve eser sözleşmesi(Medknow, 2016-11-30) Arıncı, A.; Usta, Sevgi; Law; USTA, SevgiGüzelliğin en belirgin tanımı, 18. yüzyıl Fransız Edebiyatçısı Stendhal tarafından "mutluluk vaadi" olarak yapılmıştır. Bu anlayış çağlar boyu değişmemiş ve modern insan daha da etkin biçimde, ‘fiziksel olarak güzel ve kusursuz’ olmayı güç ve mutluluğun kaynağı olarak görülmüştür. Dünya Sağlık Örgütü'nün tanımına göre sağlık; sadece hastalık ve hastalığın olmaması değil fiziksel, ruhsal ve toplumsal (sosyal) yönden de tam bir iyilik halidir. Sağlığın sözlük tanımı; bireyin fiziksel, duygusal, zihinsel ve toplumsal açıdan çevreyle uyum içinde işlev görebilme yeteneğidir. Tanımda sağlığın fiziksel olmasının yanı sıra ruhsal ve toplumsal boyutu da dikkate alınmıştır. Dolayısıyla estetik amaçlı tıbbi müdahale her ne kadar tedavi amacı taşımasa da bireyin temel insan haklarından biri olan kişinin ruhsal iyiliğini de kapsayan sağlık hakkının gerçekleştirilme araçlarından birisidir. Tıbbi müdahale türleri müdahalenin özelliğine göre ayrılmıştır. Tıbbi müdahaleler genel olarak teşhis ve tedavi amacıyla yapılan müdahaleler olarak ortaya çıkmışken tıp bilimindeki gelişim ve değişimler yeni müdahale türlerini ortaya çıkarmıştır. Tarihsel olarak estetik amaçlı tıbbi müdahale; plastik ve rekonstrüktif cerrahi müdahalelerin bir alt dalı olarak ortaya çıkmış ve gelişmiştir. Bu çeşit tıbbi müdahaleler eski çağlardan beri uygulanmakta olmasına karşın, özellikle birinci ve ikinci dünya savaşlarında yaralananların vücut bozukluklarını düzeltmek, doku ve organ kayıplarını onarmak için yapılan ameliyatlar sayesinde büyük bir gelişim göstermiştir. Apart from the Eastern Carelia and the Legality of the Use by a State of Nuclear Weapons in Armed Conflict cases, the Court has always issued its opinion on request. The Court has, whatever the objections, opted for the issuance of opinions. It has consistently followed its own precedent of never finding an obstacle concerning judicial propriety. In that regard, some indications about the term judicial propriety have been given by some advisory opinions. Still, it is not exactly defined. Both phrases play an important role in the insurance market, affecting both assureds and insurers and their respective interests under all classes of marine insurance policies. This book reviews the origin of the clauses ‘perils of the sea’ and ‘inherent vice’ by tracing back through the early cases in order to understand the origin and noting how and why the changes occurred. It will examine how the law has been developed in the recent cases and discuss whether the Supreme Court case The Cendor MOPU has overruled the previous cases in terms of the clauses ‘inherent vice’ and ‘perils of the sea’. Considering the impact of The Cendor MOPU decision with respect to the Marine Insurance Act 1906, as well as the standard Institute Cargo Clauses, it evaluates whether the decision is consistent with these things and discusses the effect of the decision on recent cases and on the insurance market.ArticlePublication Metadata only Prevalence of depression, anxiety, stress, and anger in Turkish prisoners(Wiley, 2013-09) Ünver, Yener; Yuce, M.; Bayram, M.; Bilgel, N.; Law; ÜNVER, YenerIn Turkey, prison studies are rare and the mental health status of prisoners has not received proper attention. The purpose of this cross-sectional and descriptive study was to assess the prevalence of depression, anxiety, stress, and anger among a group of Turkish prisoners. Two self-reporting instruments (the Depression Anxiety Stress Scale-42 and Multidimensional Anger Scale) were filled out by 685 prisoners. Prisoners in the study group were found to be depressive, anxious, and stressed. Anger symptoms and aggressive behaviors were found to be at a moderate level. Prisoners with a history of being subjected to domestic violence in childhood had higher depression, anxiety, and stress scores than those without such a history. Young prisoners, those who had been previously imprisoned, with substance dependency and higher stress and anxiety levels reported more anger symptoms than others. Psychological support, together with stress and anger management programs, seems to be essential.ArticlePublication Metadata only Reforming Laïcité or reforming islam? We analyze the legal actions of the State using a law-in-context approach and theorize secularism as the State's management of religion. We focus on the Senate Report (2016) concerning Muslim worship, the legal changes wrought by the state of emergency, and the institutions formed to govern Islam and secularism. We examine whether there has been a change in the French State's approach to Muslim worship. Rather than remaining neutral, the French State has become even more actively involved in the field of religion by adopting a reformist attitude intended to transform not the principles of laïcité but the Muslims in France. In this period, the State has taken concrete steps and built institutions both to support the formation of a secularized French Islam and to govern the boundaries of laïcité.Book PartPublication Metadata only Understanding the 21st century's specific Eurasian regional security and energy security parameters in the Turkish-American relationship: A case study on South Caucasus and Central Asia(Peter Lang AG, 2020-07-15) Kısacık, Sina; KISACIK, SinaEurasia has been of great importance for many centuries due to its possession of strategic trade routes and energy resources. Within this context, several states within this region, as well as outside powers, have been placing unique significance to this region in their foreign policy considerations for many decades. Countries that have been placed in South Caucasia and Central Asia were ruled by Soviets until 1991 and then gained their independence following the dissolution of the Soviet Empire. After gaining independence, these states have become more important actors in global politics due to their strategic positioning in Eurasia, reemergence of frozen conflicts between them, and most importantly, the possession of huge hydrocarbon resources in this region. In that sense, Turkey, having close political, economic, cultural, and religious links with Azerbaijan, Georgia, and all Turkic speaking-Central Asian states, has been following a multi-dimensional foreign policy towards this region. The United States (U.S.) on the other hand, as the world's only superpower left, has also been attaching special importance and following multi-dimensional strategies towards South Caucasia and Central Asia within the context of its "Wider Eurasian Strategy". In addition, both Ankara and Washington pursue these multi-dimensional foreign, security, and energy policies by considering the Russian Federation's foreign, security, and energy policy priorities, since Russia is still the dominant power in the region.
